KANSAS SILVER HAIRED LEGISLATURE MEETS IN ANNUAL SESSION

The Kansas Silver Haired Legislature held their 34th Annual Session in Topeka on October 4 – 6, 2016.  At this Annual Session, the delegates debate and vote on the issues presented to them by the Executive Board from their July meeting.  These issues, in the form of Bills and Resolutions, are subjected to a two-day process of committee hearings and debate, and then voted on two separate times before being considered as “passed”.  Those Bills and Resolutions that do survive this process are then sent to the Kansas State Legislature for consideration during the 2016 Legislative session.  It is just one way for the Senior Citizens in Kansas to have their collective voice heard.

Here are the Resolutions passed by the full body of the Kansas Silver Haired Legislature at this year’s Annual Session:

1)  Resolution No. 3301 – Urge the Kansas Legislature and the governor to fully fund all Kansas Public Employees Retirement System obligations (KPERS), including the interest at 8% on the bonds passed this past legislative session.

2)  Resolution No. 3307 – Urge the legislature and the governor to provide a cost-of-living adjustment (COLA) for each retiree who is entitled to receive a retirement benefit from KPERS.  This has not happened since 1998.

3)  Resolution No. 3302 – Urge the legislature and the governor to repeal the non-wage business income tax exemption, passed by the Kansas Legislature and signed by the governor in 2012, and replace it with a tax policy fair to all Kansans, with shared responsibility for contributing by all Kansans.

4)  Resolution No. 3303 – Urge the legislature and the governor to continue to support and fund public transportation, so vitally needed by our Kansas Senior Citizens, especially in rural areas of our state.

5)  Resolution No. 3304 – Urge the legislature and governor to restore the 30% cut to the Senior Care Act program, which allows a qualifying senior to stay in their own home with just a minimum of assistance, which averages approximately $250.00 a month.  This is a substantial savings when compared with an alternative of nursing home expenses, which can easily average around $4000.00 per month.

6)  Resolution 3305 – Urge the legislature and governor to support the expansion of Medicaid (KanCare) in Kansas.  Currently, approximately 150,000 (of which around 16,000 are Kansas seniors between the age of 60 – 65 years old) Kansans fall into the “coverage gap” – they make too much money to qualify for the base Kansas KanCare program, yet not enough to be able to afford medical insurance on their own.  The Kansas Hospital Association, and the Alliance for a Healthy Kansas are both in full support of this resolution.

The Silver Haired Legislature was created by an act of Congress in 1969, with the Kansas Silver Haired Legislature being formed in 1982.  The KSHL is charged with identifying issues important to older Kansas adults 60 years of age and older, of which there are nearly 500,000, and to educate the Kansas Legislature about those issues.  Each county is entitled to one representative, with the five largest counties having up to five additional representatives.  This coming spring, the SHL delegates from the eleven regions across Kansas will begin meeting once again to decide the issues of importance to Kansas seniors, and preparations will be made for the 35th Annual Session next fall in Topeka.  Talk to your county’s SHL delegate between now and then so the issues important to you can be considered in this next cycle.

NEW OVERTIME RULES STILL EFFECTIVE DECEMBER 1

With Donald Trump’s election comes uncertainty about the long-term prospects for the new overtime rule.  The regulation, which increases the minimum salary an employee can be paid and be classified as exempt, is scheduled to increase to $913 effective December 1, 2016.

Will Trump or Congress put the wheels into motion to limit its application?  President-Elect Donald Trump told a news outlet in a brief interview Aug. 12 that he favors a small-business exemption from the overtime rule.

Congress already has numerous proposals to delay or phase in the overtime rule. Both the House and Senate have agreed on measures which would delay the implementation of the regulation by six months.  Staff for President Barack Obama said he would likely veto them, if any reached his desk.  Come January 21st, Trump might be more receptive to them. However, this does not get employers around the December 1 effective date.

A group of 21 States, including Kansas, have challenged  the overtime rule.  Also filed on the same day, the U.S. Chamber of Commerce, National Federation of Independent Business, National Retail Federation and other business groups brought their own separate legal challenge of the overtime rule.

On Wednesday, November 16th, a Texas judge heard arguments regarding a motion for a nationwide injunction to delay the implementation of the updates to the overtime rules.  The next step is for the court to rule on the motion for a preliminary injunction, which is expected on November 22nd.  In addition, the court has scheduled a hearing date on November 28th.  This hearing would be held if the state’s motion for preliminary injunction is denied.

How to Prepare for the New Federal Overtime Rule

“The door is still open to something happening before the December 1st implementation deadline,” said Venette Davis, co-owner of H&R Block Beloit.  “Hanging your hope on the State challenge will cut implementation razor thin if the decision favors the DOL.”

“Any comp changes that are required must be implemented in the pay period that includes December 1.  For an employer who pays every two weeks and their pay period starts on Monday, November 21st, they will need to have the new pay strategy in place on Monday.”

For strategies on how to keep the pay neutral, contact H&R Block at 738-5801.

Overtime Pay Options

  • Increase comp to $913/week
  • Realign job duties to eliminate OT
  • Pay employees OT
  • Reduce hourly rate to account for average OT
  • Use a fluctuating hourly rate

COMPUTER/SMART PHONE WORKSHOP IN BELOIT

Not sure how to get started with a computer on the internet or email?  Do you have an iPAD but don’t use it for much beyond Solitaire?  Do you wish you could use more features on your Smart Phone other than to just answer the phone?  All these questions, and more, can be answered on Friday, November 4th, at the Beloit Senior Center, from 9:00 until 10:30.  The workshop is open to everyone, regardless of age, and is FREE!!!  The Mitchell County Council on Aging, as well as the Beloit Senior Center is sponsoring the event, and will feature Miss Tayler Watts, Miss Lexie Roberg, Miss Grace Marozas, and Miss Danielle Riemann of Beloit High School as the presenters.  Tayler, Lexie, Grace, and Danielle will take your questions each day, and will work with you on either your own electronic equipment, or on the computers available at the Senior Center.  No advance enrollment is required.  The participants will determine the content, as their questions will lead the discussion.  Whether novice or more advanced, Tayler, Lexie, Grace, and Danielle will help you become better suited to getting the most out of your device.

Participants are encouraged to bring their laptops, iPads, and Smart Phones to the Senior Center on either, or both, days of the workshop.  Potential topics include Skype, storing data on the iCLOUD, getting and using new APPS, taking pictures with your devices, sending and receiving pictures from and to your phone, Facebook, and any other questions the participants desire to have answered.  For further information, call the Beloit Senior Center at 738-5802. or Jay Rowh at 738-2310,  Take advantage of this opportunity to get expert, hands-on information that will help you get more out of your electronic equipment on Friday, November 4th, at the Beloit Senior Center.
